ONLINE ARBITRATION AS AN ALTERNATIVE RESOLUTION TO SETTLE CROSS-BORDER BUSINESS TO CONSUMER DISPUTES
The main aim of this paper is to determine the effectiveness of online arbitration as an alternative to cross-border business to consumer disputes. The study also investigates the different formats applicable for online arbitration as alternative dispute resolution for settling cross border business to consumer disputes. Finally, the study investigates the characteristics of online dispute resolution. The study will be explorative in nature and will use secondary resources to gather data related to online dispute resolution. The data will be analyzed through thematic analysis to answer the research questions. Initial investigations illustrates that online arbitration is an effective alternative dispute resolution method to settle cross border disputes between customers to business. Also, there are several formats for online dispute resolution. The online dispute resolution for settling business to customer disputes are characterized in that they are voluntary, informal, confidential, and assisted. This study will fill the gap in research by providing insights to the effectiveness of online arbitration as an alternative dispute resolution mechanism for settling business to customer issues. The study will also provide lessons that can be used by the lawyers, the businesses, and the customers in matters related to online transactions.
